Bellingham, Wash. — According to court documents, several evaluators determined late last month that the 37-year-old suspect was not competent to stand trial.

Psychological evaluators concluded that, due to a developmental disability, he likely would not benefit from competency restoration.

Police reports from his arrest had earlier indicated the suspect did not appear to understand why he was being arrested or the seriousness of the allegations against him.

The charges stem from a May 19 incident at PeaceHealth St. Joseph Medical Center. According to court documents, the child, a patient at the hospital, was waiting to use a restroom when the suspect, unclothed opened the restroom door, grabbed the child, and assaulted them inside.

The child was assaulted a second time after attempting to use the same restroom some time later. A nurse knocked on the door, and staff were able to separate the two before police took the suspect into custody.

The man had been held at the Whatcom County Jail without bail and was ordered to undergo a competency evaluation. With the charges now dismissed, he is no longer facing prosecution in the case.
